Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.   

Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site, without our prior written consent.   

Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site, use of the Site, or access to the Site without our express written permission.

Ownership: The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by HammerHead Anchors, LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.   

Trademarks: The HammerHead Anchors name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of HammerHead Anchors, LLC or its affiliates or licensors. You must not use such marks without our prior written permission.

Limited License: Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Site solely for your personal, non-commercial use (or internal business use as stated above).   

Restrictions: You must not modify, copy, reproduce, republish, upload, post, transmit, distribute, or create derivative works based upon the Site or its content, in whole or in part, without our express written consent.

4. User Content:

Responsibility: You are solely responsible for any content that you post, upload, submit, or otherwise make available on or through the Site ("User Content"). You represent and warrant that you have all necessary rights to submit such User Content and that it does not violate these Terms or the rights of any third party.   

License to User Content: By submitting User Content, you grant HammerHead Anchors a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media for any purpose related to the Site and our business, including promotional and marketing purposes.   

Monitoring and Removal: We have the right, but not the obligation, to monitor, review, edit, refuse to post, or remove any User Content for any reason in our sole discretion, including if we believe it violates these Terms.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HAMMERHEAD ANCHORS, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. HAMMERHEAD ANCHORS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY RELIANCE ON THE CONTENT OF THE SITE IS AT YOUR OWN RISK.   

7. Limitation of Liability:

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAMMERHEAD ANCHORS, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED FIFTY US DOLLARS ($50)].   

8. Indemnification:

9. Governing Law and Dispute Resolution:

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of  Texas, without regard to its conflict of law principles.   

Dispute Resolution: Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to binding arbitration in Williamson County, Texas, or exclusive jurisdiction in the state and federal courts located in Williamson County, Texas. You hereby consent to such jurisdiction and venue.   

10. Termination:

We reserve the right, in our sole discretion, to terminate or suspend your access to all or any part of the Site, with or without notice, for any reason, including without limitation your breach of these Terms. Upon termination, your right to use the Site will cease immediately.   

11. Modifications to the Terms:

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.   

12. Entire Agreement:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HammerHead Anchors, LLC with respect to the Site and supersede all prior or contemporaneous communications and proposals, whether oral or written.   

13. Severability:

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.   

14. Waiver:

No waiver by HammerHead Anchors of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of HammerHead Anchors to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
